MINUTES

Members Present: Michael Scott, Robert Lowell, Anthony Costello, Matt Kennedy and Ken Strom.

Members Absent: none

Staff Present: Pamela Harding, Teresa McIntyre

The meeting began at 7:00 PM

ALDEN WOODS – The applicant requested that the easement on Lots 218 and 219 be removed. He indicated that the owners did not want to give up any property in the rear of their lots for an easement. Following the discussion, the Conservation Commission requested the residences be notified that if a legal easement isn't granted in the rear of the lots, then it will be relocated to the front of the lots.

NOTICE OF INTENT - Winterberry Hollow - Continued until the next meeting on October 7, 2009.

NOTICE OF INTENT - Oaks of Holden - S. Morrison, representing Eco-Tec, presented the proposal to rebuild the retaining wall. Work will include finishing a 4800 sq ft replication area. M. Lowell requested that the perforated pipe currently proposed to connect the drains between the old wall and new wall, be replaced with a solide pipe. With no questions or comments from the public, M. Scott made a motion to close the hearing. R. Lowell seconded. All were in favor. Then M. Scott made the motion to issue a standard Order of Conditions with the added condition that the perforated pipe connecting the drains between the walls (the lateral lines) be replaced with a solid pipe. K. Strom seconded the motion. All were in favor.

NOTICE OF INTENT - Ottoson Way - Applicant presented proposal to build a single-family residence within 100 ft of a wetland boundary. Applicant wants to clear the lot beyond the sewer easment. P. Harding read a fax from DCR that requested that the yard clearance not occur beyond the sewer easement. R. Lowell concurred with DCR. The floor was opened to the public for comments. Abutters, M. Cataldo and R. Soderberg, both commented on the past use of the easement. D. Hazen, representing the town, stated that he would prefer to see the easement maintained. A. lengthy discussion continued between the Conservation Commission and the applicant. An option was offered to the applicant, to close the hearing or apply for a variance from DCR.  Following the discussion, R. Lowell made a motion to close the hearing. M. Scott seconded the motion. Then R. Lowell made a motion to issue a standard Order of Conditions with the additional condition that the thinning of shrubs can occur beyond the northern boundary of the sewer easement, but no trees are to be removed. K. Strom seconded the motion. All were in favor.

NOTICE OF INTENT - 109 Arizona Ave Lots 1 & 2 - D. Faist presented his proposal regarding the construction of a single-family residence within a 100' buffer zone. Discussion ensued focusing on the wetland crossing. This discussion resulted in three areas that the Conservation Commission requested responses from the applicant by the next meeting: use of arch versus embedded pipe at the crossings, use of seamless oil pipe for the sewer line, and a response from National Heritage. Continued until next meeting on October 7.

CERTIFICATE OF COMPLIANCE - Lot 14 & 26 - Wagner Meadows - Easements need to be mowed before the Certificate of Compliance will be issued.

CERTIFICATE OF COMPLIANCE - Lot 13 - Wagner Meadows - Work has been completed. R. Lowell made a motion to issue a Certificate of Compliance. M. Scott seconded the motion. Vote was 4-0. K. Strom recused himself.

APPROVAL OF MINUTES - R. Lowell - made a motion to accept the Minutes of August 5, 2009. M. Scott seconded the motion. All were in favor.

R. Lowell made a motion to adjourn. K. Strom seconded the motion. All were in favor.

The meeting adjourned at 8:50 PM.

The next meeting is scheduled for October 7, 2009.
